Since April 2024 a live-in nanny, housekeeper or carer has been entitled to the National Minimum Wage like any other worker; the exemption for staff treated as part of the family is gone. In Kensington and Chelsea, where private households employ large numbers of domestic staff, that change has sent both employers and employees to solicitors: for contracts, back pay claims and advice on what a household must now record and pay. Employment law here is unusual in other ways too. Embassies and the residences along Kensington Palace Gardens employ local staff who, when dismissed, run into state immunity, which the courts have narrowed in recent years but not removed, and diplomats' own household workers face similar obstacles.
The borough's larger employers are more conventional. The Royal Marsden, the Chelsea and Westminster and the Royal Brompton bring NHS whistleblowing, disciplinary and discrimination cases; the museums, the Knightsbridge stores, the hotels and the galleries bring redundancy, restructuring and the casual contracts of retail and hospitality; the council and its contractors bring public-sector grievances. Private schools and tutoring agencies raise questions about status and notice that a Kensington and Chelsea employment solicitor sees often.
Whatever the employer, a claim must go through Acas early conciliation before three months less a day have passed since the dismissal or the act complained of, and is then heard at the London Central employment tribunal in Holborn. Settlement agreements require independent advice, usually paid for by the employer. Employers use the same firms for contracts, handbooks, sponsorship compliance and tribunal defence.
Most firms quote fixed fees for settlement agreements and contract reviews, hourly or staged fees for claims, and a free first conversation.
