Where was the wedding? For an Enfield divorce solicitor it is one of the first questions, because so many of the borough's marriages were celebrated in Cyprus or Turkey, in a church in Palmers Green, or in a religious ceremony that was never registered. A marriage valid where it took place is valid here, and the divorce can go through the English courts; a religious-only ceremony may be no marriage at all in English law, leaving the couple with the far weaker rights of cohabitants. Property in Larnaca or Istanbul, and parents who expect a say, add complications that a solicitor on Green Lanes or in Enfield Town will have seen before.
The procedure itself is the same for everyone. Since April 2022 nobody has had to prove adultery or unreasonable behaviour; one spouse or both apply online, a conditional order can be made after twenty weeks, and the final order six weeks after that. The work lies in the finances, which the divorce does not settle on its own. Enfield's homes range from a detached house in Hadley Wood to a right-to-buy flat in Edmonton, and whether the family home is sold, kept for the children or transferred to one spouse depends on mortgage capacity, housing need and what else exists: NHS and council pensions, a family business, savings abroad. The agreement is written up as a consent order and approved by the family court at Edmonton without anyone attending; disagreements are decided there once mediation has been tried.
Legal aid for divorce is confined to cases with evidence of domestic abuse. Most Enfield firms charge a fixed fee for the divorce application and hourly rates, with a written estimate, for the financial side.
